ASPEK HUKUM DANA PERLINDUNGAN PEMODAL DAN DISGORGEMENT FUND DALAM PERSPEKTIF PERLINDUNGAN INVESTOR PASAR MODAL

This research aims to identify and analyze the scope of the investor protection fund and disgorgement fund. An investor protection fund is a collection of funds formed to protect investors from the loss of an investor’s assets. Meanwhile, disgorgement funds are funds collected from the imposition of illegal profit returns with the aim of being administered and distributed to investors who are harmed and meet the requirements to file claims.
This research is normative legal research, which examines the applicable provisions regarding the existence of investor protection funds and disgorgement funds, which in this case discusses the scope of each from the perspective of investor protection. Secondary data is in the form of primary legal materials that will be reviewed in the form of laws and regulations relating to the investor protection fund and disgorgement fund.
The results show that the scope of investor protection funds is only limited to the loss of investors' assets in securities companies and custodian banks, meanwhile, the scope of capital market investor protection through disgorgement funds is wider than investor protection funds, covering almost all types of violations in the capital market. However, the mechanism for establishing the fund is different from that of an investor protection fund. The formation of the disgorgement fund is carried out after the feasibility assessment of the formation of the compensation fund.
