PERDAGANGAN INTERNASIONAL DALAM KRISIS KESEHATAN: TANTANGAN, RESPONS ANGGOTA WTO DAN PROSPEK PENGUATAN SISTEM PERDAGANGAN MULTILATERAL

Perdagangan adalah proses yang berkelanjutan yang selalu terjadi secara teratur. Dalam kasus fenomena parsial tiba-tiba muncul terutama masalah kesehatan, itu akan mempengaruhi perdagangan dalam hal rantai pasokan barang, tetapi tidak pernah menunda distribusi sepenuhnya. Anggota WTO secara responsif dan sementara menerapkan tindakan yang menghalangi perdagangan. Seiring berjalannya waktu, tindakan unilateral dapat diambil terlepas dari kewajiban anggota untuk membuka akses pasar sebagai prinsip inti dalam aturan WTO. Artikel ini akan membahas bagaimana anggota memenuhi kewajiban mereka selama masalah kesehatan dengan memberlakukan tindakan tertentu; dan bagaimana tindakan unilateral dapat memperkuat sistem perdagangan multilateral dan menciptakan liberalisasi perdagangan pada tahap berikutnya. Artikel ini akan ditulis sesuai dengan metode yuridis normatif dengan pendekatan historis sebagai gagasan utama dari proses analisis. Artikel ini akan menampung gagasan konseptual yang didasarkan pada aturan WTO dan merefleksikan fenomena dalam skala ekonomi lebih lanjut untuk mempertahankan perdagangan yang sedang berlangsung oleh anggota. Setelah itu, anggota dapat merespon dengan benar setiap masalah kesehatan yang terkait dengan rantai distribusi barang. Dengan memberlakukan tindakan yang dapat diakui kepada anggota WTO secara kolektif.
