Abstract

Gagasan tentang kesehatan sebagai hak merupakan jelas tampak dalam laporan 2010 lembaga Amnesti Internasional (AI) tentang hak akses ke layanan kesehatan reporduktif. Laporan tersebut mendudukkan wanita sebagai korban diskriminasi kebijakan kesehatan. Masih ada lagi diskriminasi berkaitan dengan gaya hidup seperi sex yang konsensual, kohabitasi, aborsi dan isu-isu lain yang diyakini bisa merugikan wanita. Guna mempertahankan hak wanita akan layanan kesehatan, laporan

AI pada 2010 menuntut pencabutan diskriminasi melawan hak kesehatan reproduktif wanita. Berdasarkan pengertian Amyrta Sen tentang “keadilan kesehatan”, makalah ini mengedepankan pandangan bahwa (1) ketidakadilan dan diskriminasi yang sengaja diciptakan dalam komunitas harus ditiadakan karena menghalangi realisasi keberdayaan manusia; (2) Kendati ketidakadilan alami terjadi di masyarakat, manusia masih dapat merealisasikan keberdayaannya; (3) Pewujudan layanan kesehatan reporduktif dapat dilaksanakan melalui perjuangan mengeliminasi ketidakadilan yang sengaja diciptakan tanpa harus mengimplementasi layanan kesehatan sebagai hak yang dapat merusak nilai-nilai kultural dan kebijaksanaan lokal.
